Divisional Instructions

HEARINGS:
Uniform Motion Calendar: Tuesday thru Thursday @ 8:45 a.m. All discovery and non evidentiary motions and uncontested final hearings may be heard for a maximum of 10 minutes. Attorney must first file the original notice of hearing 5 working days in advance (fax in not acceptable) to the clerk and copy to opposing counsel and JA. That sets the hearing. The attorney setting the hearing should always coordinate the date with opposing counsel. Local Rule 4 needs to be followed, which requires the Lawyer to certify that in advance of the hearing, they conferred and attempted to resolve the matter before the Court. Administrative Order 5.201(formerly 5.002)

Temporary Relief Hearing:
You may contact the JA to get a date and time. Mediation must be completed or waived by court order. After mediation has been completed, the attorney’s office may call the Judge’s office and the JA will give them the next available date usually within 3 weeks. Administrative Order 5.207(formerly 5.006)

Evidentiary Hearing/ Non Temporary Relief:
Does not require mediation.

Trials:
The moving party must file a Notice to Set Cause for Trial stating that the case is at issue and ready for trial. An accurate estimate of the length of the trial is required. Once received by the JA the notice is held for 5 days pending any objections. These trials are set at next available date after 30 days. An Order Setting Trial is then sent out with the date & time that is available at the time of filing the notice. These hearings can not be canceled. They must be presented to the Judge on the UMC before the scheduled hearing or the day of the hearing as an uncontested final hearing.

Adoption Hearings:
TPR or Final Hearings are set by the JA.

Special Instructions:

    1. When you are sending in orders to be signed by the Judge, please provide enough copies (1 for original, 1 for yourself & 1 for opposing counsel) & self addressed envelopes.
    2. When you are sending in Orders of Referral to Magistrate, please send in a copy of the motion & enough copies for all sides, including the Magistrate & self addressed envelopes, excluding the Magistrate. Please follow the same steps when sending Orders for Mediation, except send in a copy for the Mediation office and not the Magistrate.
