CHANGE IN UNIFORM MOTION CALENDAR ON-LINE SCHEDULING FOR DIVISION AW
EFFECTIVE AUGUST 1, 2017
The procedure for the on-line scheduling of Uniform Motion Calendar (UMC) hearings is being changed. Parties will no longer be able to set UMC hearings for a date less than three (3) business days prior to desired hearing date. In addition, motions for the cancellation of foreclosure sales and motions to continue or cancel trials will no longer be offered on an expedited basis.
EFFECTIVE AUGUST 1, 2017, Any post judgment motion (excluding attorneys fees hearings, deficiency judgments, cases in active bankruptcy or on appeal) filed but not scheduled for hearing within six (6) months of the filing date shall be deemed abandoned and the court shall direct the clerk to reclose the file. The Order will be without prejudice to any party to refile the motion and timely set it for hearing.
CHANGE IN PROCEDURE FOR SPECIAL SET HEARINGS
CHANGE IN PROCEDURE EFFECTIVE JANUARY 17, 2017: Upon scheduling of your hearing on-line the foreclosure staff will generate an Order Special Setting Hearing. They will scan and email the signed Order Specially Setting Hearing to ALL REGISTERED USERS AND MAIL COPIES TO ANY PARTY IN THE CASE NOT REGISTERED TO RECEIVED EMAIL. A COURTESY COPY SHALL IMMEDIATELY BE SENT BY U.S. MAIL ATTENTION JUDGE Ferrara WITH A COPY OF THE ORDER SETTING HEARING ATTACHED TO ALL SUBMISSIONS AND REPLY OR RESPONSE SHALL BE SENT WITHIN 10 DAYS BEFORE THE HEARING CLEARLY MARKED REPLY/RESPONSE. CHANGE IN PROCEDURE FOR UNIFORM MOTION CALENDAR AND CASE MANAGEMENT HEARINGS
Uniform Motion Calendar is now set on-line. In order to have your motion heard before the foreclosure division, you must first check on-line for the next available date and clear it with other parties in the case. After scheduling the hearing a coutesy copy of the the Notice of Hearing and Motion (and supporting documents) shall immediately be sent attention JUDGE FERRARA. The motion and a Notice of Hearing must be filed with the Clerk's Office. Please provide all interested parties courtesy copies of your motion and Notice of Hearing. Five (5) business days notice are required unless shorter notice is agreed upon with all parties. Uniform Motion Calendar is held Monday through Thursday at 8:45 a.m. Please instruct parties to see white board on the 4th floor in front of courtroom 4A for courtroom designation. All partes must check-in with the deputy. Motion to Cancel Sales and Motions for Continuance may not be heard on an expedited basis any longer but must be scheduled on-line timely to be heard. Please do not send in an emergency motion if there is hearing time available to be heard timely and do not title them as emergencies if setting them for hearing.
