Divisional Instructions for
Criminal Division "W"

SETTING MORNING CALENDAR HEARINGS:  Hearings are typically held Monday thru Friday at 8:30 a.m. for matters taking 10 minutes or less.  Attorneys must contact the Judicial Assistant for an available hearing time and are not permitted to unilaterally set hearings.  

1. Please file your Motion first.

2. Contact the Judicial Assistant for available hearing time via email (CAD-divisionW@pbcgov.org) or telephone (561-355-1980). 

3. Clear one of the dates from the JA with your opposing counsel.

4. Once the parties have agreed to a date please email the Judicial Assistant a copy of your Notice of Hearing and Motion to the CAD-divisionW@pbcgov.org


NOTE: Counsel must appear promptly for all scheduled hearings set before the Court. ‚Äč

Cancellations:  Cancellations are not permitted, please see Motions to Continue below. If you feel that you have a special circumstance, please contact the JA.    
All Specially Set Hearings 15 minutes or more:    All hearings that will require 15 mins. or more will be specially set for a hearing on the Court's docket.   The moving attorney shall contact the JA and the JA will give the moving attorney dates and times to coordinate with opposing counsel. Once a date and time have been agreed to by the attorneys, the moving attorney's office must contact the JA again to secure the date and time the attorneys have agreed upon. ORIGINAL MOTIONS MUST BE FILED WITH THE CLERK BEFORE CONTACTING JA TO OBTAIN HEARING TIME. 
MOTIONS FOR CONTINUANCE:   All Motions for Continuance MUST be set on the Judges 8:30 morning calendar, please call or email the JA for hearing time once your motion has been docketed. Once a case is on 2 hour call a continuance will only be granted upon a showing of extraordinary circumstances. Extraordinary circumstances do not include the unavailability of a witness under subpoena or the need to take a deposition. The Judge will not entertain any motions during the Calendar Call.

TELEPHONIC APPEARANCES: Telephonic appearances are permitted for attorneys only and for Morning Calendar only. All telephonic appearances must be cleared with the JA no later than 48 hours prior to the hearing date. A notice of telephonic appearance must be filed and contain all the hearing information in it including the name and number where the party can be reached (we do not use CourtCall for our division). A copy of the Notice of Telephonic Appearance must be e-mailed to CAD-DivisionW@pbcgov.org and the subject line must read "Notice of Hearing- telephonic appearance- Case Style, Case #".


EMERGENCY HEARINGS/MOTIONS: Requests for emergency hearings/Emergency Motions are decided by the Court. The movant must file their Emergency Motion with the Clerk. The Clerk will then distribute the Emergency Motion to the Judge and the Judge will review the Motion and decide if an emergency hearing is warranted. If the Court deems the matter an emergency, the JA will contact the parties so advising them of the Courts decision. When filing an Emergency Motion make sure the opposing side is also in receipt of the motion with any attachments. 


MOTIONS FOR REHEARING:   Attorney shall file the original pleading with the Clerk and copy the Court. The Court will review the pleading and shall either deny or grant the motion or shall set the motion for a hearing. This type of Motion is NEVER to be set for hearing by the Parties unless directly requested by the Judge.


PROPOSED ORDERS: If you have an AGREED ORDER you may submit it to the CAD-divisionW@pbcgov.org email address for the Courts review. Make sure the e-mail subject line reads "Proposed Order- Case style, Case #", the Proposed Order must be in WORD format and not PDF(we cannot process PDF's for e-service and e-filing). Also provide any pertinent attachments such as the Motion relating to the proposed order etc. If the Proposed order is NOT AGREED TO, you must have a hearing on the matter, contact the JA once the Motion has been filed for hearing time. *** we do not accept Agreed Orders on Motions to Continue, please refer to the Motions for Continuance section above***


JURY INSTRUCTIONS: On or before the first day of trial please submit proposed jury instructions to the CAD-divisionW@pbcgov.org email address and make sure the e-mail subject line reads "Jury Instructions- Case style, Case #".
