Until further notice the uniform motion calendar is suspended on Mondays. Mondays are specifically reserved for case disposition hearings and other matters specially set by the Court. Attorneys must contact the Judicial Assistant before setting any hearings on Mondays
Pretrial Conferences, Trial, and Motions to Continue Trial
Beginning August 8, 2011 the following procedures shall generally apply to all new case dispositions:
All DUIs and all other misdemeanors (excluding DUS charges) will be set directly for trial
All DUS cases will be set as follows:One pretrial conference will be set at case disposition.Trial will be set at the pretrial conference, if necessary.
ALL PRETRIAL MOTIONS MUST BE FILED AND HEARD PRIOR TO TRIAL IN ALL CASES.
A party may call up a matter for a status, plea or motion hearing by filing the appropriate Notice of Hearing in accordance with the Divisional procedures outlined.
Motions to Continue Trial.All motions to continue trial should be filed with the clerk no less than 10 days prior to trial date with a courtesy copy sent to the Judge’s chambers. Even AGREED Motions to Continue TrialMUST be set for a hearing by contacting the Judicial Assistant.
The above procedure may be modified by motion on a case-by-case basis for good cause shown and is also subject to Fla. R. Crim. P. 3.191.
Motions for Deposition. All motions for depositions should only be filed and set for a hearing when they are NOT agreed to by the opposing party.
Administrative Order No. 4.306-9/08* - Motions to Depose
All motions to depose shall be in writing and shall specify the basis for good cause.
No motion to depose will be heard unless the motion bears a certificate of moving counsel stating that he or she contacted opposing counsel and attempted to resolve the issue without a hearing, but that the matter could not be resolved.
