Divisional Instructions

 

UNIFORM MOTION CALENDAR:

Uniform Motion Calendar hearings are held MONDAY - THURSDAY @ 8:45 A.M., and require five (5) business days notice to all opposing counsel. The calendar is first come - first served. You do not need to call the Judicial Assistant to schedule or cancel your hearing. NO TELEPHONE HEARINGS ARE PERMITTED ON THE MOTION CALENDAR. A courtesy copy of the notice of hearing and motion must be sent to the judge for review prior to hearing. All motions which require review of other pleadings, such as motions to dismiss, must include a copy of all relevant pleadings, such as the pleading you are seeking to dismiss, e.g. Complaint, Counter-Claim, etc.  Only one motion will be heard, unless time permits at the end of the calendar.

TELEPHONE HEARINGS:

ONLY specially set hearings can be done by telephone. You must contact the Judicial Assistant five (5) business hours prior to the hearing to make telephone arrangements. If more than one party appears by telephone, the moving party shall set up the telephone conference. All telephone hearings are set on the court’s unpublished conference number and are initiated by the moving party. (THE NUMBER WILL BE GIVEN TO THE PARTY AT THE TIME OF REQUEST.) No telephone hearings are conducted on the judge’s chambers telephone number.

FORECLOSURE HEARINGS:

All foreclosure cases set for hearing in Division AH are required to have a completed Foreclosure Form submitted with their paperwork. The forms are available in the “Forms & Orders” section on this website.

SPECIALLY SET HEARINGS REGARDING ORDERS TO SHOW CAUSE:

All Orders to Show Cause shall include a provision for service on the Defendant at least two (2) business days prior to the court date. If service has not been made on Defendant at least two (2) business days prior to the court date, counsel shall immediately notify the judge’s chambers. All Orders to Show Cause shall include a provision directing the Clerk of Court to forthwith provide counsel with the appropriate number of certified copies upon payment of the Clerk’s fee, which shall be made to the Clerk within 72 hours of receipt of the conformed Order to Show Cause.

SPECIALLY SET HEARINGS:

SPECIALLY SET HEARINGS ARE SET BY CONTACTING THE JUDICIAL ASSISTANT AND ARE SET BY COURT ORDER AND CANNOT BE CANCELLED EXCEPT BY FURTHER ORDER OF THE COURT. THE JUDICIAL ASSISTANT CANNOT CANCEL OR CONTINUE A SPECIALLY SET HEARING. THIS CAN BE DONE ONLY BY THE JUDGE.

All motions must be filed with the clerk prior to obtaining a court date. When scheduling a special set hearing you must provide the Judicial Assistant with the date the written motion was filed with the clerk. All hearing dates must be cleared with all opposing counsel. A COURTESY COPY OF ALL MEMOS OF LAW MUST BE SUBMITTED TO THE JUDGE AT LEAST FIVE (5) BUSINESS DAYS PRIOR TO HEARING, WITH THE DATE AND TIME OF HEARING PROMINENTLY MARKED ON THE COVER LETTER. All cases and legal authorities submitted to the judge must be tabbed, with pertinent sections highlighted.

SUBMITTING PROPOSED ORDERS TO THE COURT:

All proposed orders submitted to the court must include an original order with enough copies for all counsel/parties and self-addressed stamped envelopes with the correct postage.

NOTICES TO SET CAUSE FOR TRIAL:

All original notices should be submitted directly to the clerk. A courtesy copy of the notice should be submitted to the judge with self-addressed stamped envelopes and the judicial assistant will prepare the Order Setting Trial.  Please include the telephone number for all counsel on the notice.

 REQUESTS FOR EMERGENCY HEARINGS:

Pursuant to Administrative Order 3.206-1/09, requests for emergency hearings shall be decided by each judge solely upon the judge’s review of the motion. Upon receiving a request for emergency hearing, the judge shall decide whether an emergency exists, and if so, shall schedule a hearing, enter any ex-parte order deemed necessary, or take any other appropriate action.

PETITIONS FOR REHEARING:

Pursuant to Local Rule 6, with the exception of motions for new trial or rehearing pursuant to Rule 1.350, Florida Rule of Civil Procedure, or similar procedural rule, no petition for rehearing, motion for reconsideration, or like pleading, shall be set for oral argument except upon court order. The petition or motion shall be filed with the Clerk and a copy shall be furnished to the assigned judge (with self-addressed stamped envelopes), along with a copy of the original order. Upon consideration of the matter, the judge shall either deny the petition or motion, or shall set it for oral argument.
