POLICIES AND PROCEDURES


    

ALL DEFENDANTS ARE TO APPEAR IN COURT, UNLESS PRIOR APPROVAL OF THE COURT

1. ARRAIGNMENTS:

    In all cases the Clerk routinely sets all arraignments for Thursday mornings at 8:30 a.m. at which time all defendants shall be present.  If a written plea of not guilty has been filed then the Court will set a case disposition date 30-45 days after the scheduled arraignment.

2. SETTING HEARINGS FIVE (5) MINUTES OR LESS:

    Judge Burton has an open uniform motion calendar (UMC) on Monday thru Friday at 8:30 a.m.  You do not have to call the Judicial Assistant to set a five (5) minute motion hearing.  When setting your five (5) minute motion hearing be sure you notice all parties with proper notice and serve the Judge with a courtesy copy of the motion and notice of hearing.  Also, be sure to check Judge Burton's suspension dates, so that your hearing is not set on a day that Judge Burton does not have court. 

3. SPECIAL SET MOTIONS:

    Motions requiring fifteen (15) minutes or longer are specially set by the court.  The moving party should provide to the judge a courtesy copy of the motion along with a cover letter/memorandum advising the court how much time the party needs set aside for the motion and when the case is next scheduled for court.

4. PROPOSED ORDERS:

     When submitting proposed orders for the Court's signature, please be sure to provide the court with an original and sufficient copies for conforming, along with self -addressed stamped envelopes.


5. CONTINUANCES:
    
    Any continuation cannot be continued by agreement, only by the Court.  If a party desires to continue a matter without court hearing, the motion must be in writing, with a courtesy copy to the Court accompanied with a proposed order.  The Court will review the motion, and either order a new court date in chambers or will have the judicial assistant set a court hearing.

6. PRELIMINARY VIOLATIONS OF PROBATION:

    Will be set Monday through Friday at 8:30 a.m. by the clerk of court.
    
7. SUSPENSION DATES:
 
       Suspension dates are updated on an as needed basis.  Our suspension dates are recorded on the voice mail message and listed on the Fifteenth Judicial Circuit Website (15thcircuit.co.palm-beach.fl.us).
