Divisional Instructions


EX-PARTE/UNIFORM MOTION CALENDAR

  1. Ex-Parte/Uniform Motion Calendar will be held on Tuesday, Wednesday & Thursday’s @ 8:45 a.m. except for scheduled suspended days. Call (561)330-1750 for Judge Colin’s suspension dates & you can also check the website @ www.15thcircuit.com.
  2. All files for Ex-Parte only (You do not need to order your file for UMC or special sets) must be ordered from the Clerk of Court the day prior to the hearing before 2:00 p.m. You must order your file online @ www.15thcricuit.com.
  3. You must notice your matter for hearing 5 days prior to the hearing. Send the original Notice of Hearing to the Clerk of Court with a copy to the JA.
  4. FILES ARE REQUIRED for EVERY Ex-Parte hearing. (This is for Ex-Parte only files are not necessary for UMC) If your file is not with the Ex-Parte Clerk you would have one of two options:
    1. Return on the next Ex-Parte day;
    2. Leave your paperwork with the Clerk, together with your stamped self-addressed envelope (if you need a conformed copies) and your file will be processed together with motions filed through the mail.
  5. EXCEPTION: ONLY cases opened the day of appearance will be heard without the file.
  6. No files will be pulled the morning of Ex-Parte.
  7. The following motions WILL NOT be heard on Ex-Parte/UMC:
    1. Petition for Attorney Fees or Guardian Fees
    2. Petition to Approve Minor’s Settlement
    3. Orders of Discharge
    4. Appointment of Emergency Temporary Guardian
    5. Small Estates
    6. All Contested or Evidentiary Hearings

Trials:
The moving party must file a Notice to Set Cause for Trial (Anything over 2 hours needs to be noticed) stating that the case is at issue and ready for trial. An accurate estimate of the length of the trial is required. Once received by the JA the notice is held for 5 days pending any objections. These trials are set at the next available date after 30 days. An Order Setting Trial is then sent out with the date & time that is available at the time of the filing of the notice. These hearings cannot be canceled. They must be presented to the Judge on the UMC before the scheduled hearing or the day of the hearing as an uncontested final hearing.

Notice of Cancelations/Motion for Continuation:
These matters will not be addressed by mail or by phone. You must set the matter on Judge Colin’s UMC prior to the time of your scheduled hearing. Please do not set hearings with the JA unless you have properly coordinated with all interested parties and checked your calendar thoroughly.

Special Instructions:

  1. When you are sending in orders to be signed by the Judge, please provide enough copies (1 for original, 1 for yourself & 1 for opposing counsel) & self addressed envelopes.
  2. When sending in orders that may be on the bulker side, please provide an envelope that can accommodate the paperwork & enough postage.
  3. When you get dates from the JA & you need to coordinate, please make sure that you do not notice it for hearing until you have personally confirmed with the JA.
