Magistrate Williams Divisional Instruuctions
UNIFORM MOTION CALENDAR
The Uniform Motion Calendar (UMC) is CURRENTLY held every week on Tuesday from 8:30 a.m. to 9:30 a.m. for non-evidentiary matters only. HOWEVER, EFFECTIVE THE WEEK OF JUNE 13, 2011 the UMC calendar will be held on Thursdays from 8:30am to 9:30am with the first UMC calendar for that week being held on Thursday June 16, 2011 from 8:30am to 9:30am and on every Thursday thereafter, unless the UMC calendar is suspended. Please submit a copy of the Motion and Notice of Hearing to the Magistrate’s office five (5) business days prior to the hearing. At the UMC hearing, the moving party must present to the Magistrate the following: A signed copy of the Order of Referral (if applicable), a copy of their motion, a copy of the notice of hearing, and a proposed order with the appropriate number of copies to be conformed, along with self-addressed, stamped envelopes. The proposed order should have the appropriate Divisional Judge’s name on the signatory line. Attorneys or pro se parties will be limited to five minutes each to present argument for or against the matter to be heard. Piggy-backing of multiple motions will not be permitted.
SCHEDULING HEARINGS:
For all Supplemental Petitions to Modify Child Support or other Non-child support Supplemental Petitions that have been referred (by Order of Referral) to the Magistrate, a Notice for Trial, specifying the pending matter(s) and identifying the amount of time needed to try the matter shall be filed. A courtesy copy of the Notice for Trial and two (2) stamped envelopes shall be sent to the Magistrate. The Magistrate will then issue an Order Setting Case on her Trial Docket which will identify a date for Calendar Call and the week during which the matter may be set for Trial.
For all other matters that require a hearing before the Magistrate, the party requesting said hearing shall submit a letter to the Magistrate’s office (with a copy to the opposing party) and shall include a) an estimate of the time needed to hear the matter, b) a copy of the order of referral, and c) a copy of the Motion(s) and d) two (2) stamped envelopes. The Magistrate’s staff will make every effort to contact the parties to schedule a hearing. PLEASE NOTE THAT THE MAGISTRATE’S OFFICE, MAY, FROM TIME TO TIME AND AS THE CIRCUMSTANCES REQUIRE SCHEDULE HEARINGS WITHOUT COORDINATING SAME WITH THE PARTIES.
Documents; Envelopes Required
1. If a Party wants to submit documents for the Court’s consideration during a hearing, then that Party shall bring TWO (2) COPIES of that document; one for the Court and one for the other Party.
2. If a party is seeking enforcement of child support, alimony, health insurance premiums, medical expense reimbursement, day care/summer camp costs, etc. which are NOT paid through the State Disbursement Unit (SDU) in Tallahassee, then the Party seeking enforcement shall prepare and having available at the hearing TWO (2) copies of a detailed organized, itemized, and summarized statement of what was owed, what was paid, and what has not been paid. Said party shall also provide TWO (2) copies of the supporting bills, cancelled checks, credit card or other receipts.
3. The Moving Party shall bring 2 stamped envelopes for a hearing only involving child support and 4 stamped envelopes if there are any issues other than child support.
Continuances
Any request for continuance must be in writing and co-signed by the Client and noticed for Hearing on the U.M.C. Calendar. Alternatively, if the continuance is agreed to by opposing Counsel, a Stipulation signed by both Counsel and their Clients should be submitted together with an Order either: (a) assigning a new hearing or non-jury trial date; or, setting a Status Conference to revisit a reset date.
Cancellations
Cancellations may occur by (1) Agreed Order confirming that the matter has been resolved and the pending Matter resolved or withdrawn; or (2) Notice of Cancellation confirming that the matter has been resolved and the pending Motion or Petition resolved or withdrawn. Only the party setting the matter may file a Notice of Cancellation.
Telephonic Appearances
The General Magistrate does not oppose any party or witness appearing telephonically as long as the other side stipulates to same in writing in advance of the hearing or non-jury trial. However, the cost of the telephonic appearance, if long distance, will not be borne by the Court
