Divisional Instructions


  Refer to Local Rule 4 Adobe PDF  - UNIFORM MOTION CALENDAR is Monday - Thursday at 8:45 a.m. barring any suspension dates.  Hearings shall be limited to ten minutes per case. 


Please check suspension days.     Scheduling is between the parties.  Do not call the Judicial Assistant for scheduling on UMC.  Unless waived by agreement, the movant should give reasonable notice of the hearing to all opposing parties.  See Palm Beach County Bar Association Standards of Professional Courtesy. Adobe PDF  Please follow all of the criteria for setting an 8:45 Uniform Motion Hearing per Local Rule #4Adobe PDF and be most mindful to Item #3, concerning the length of the hearing and review time for the Court.  A courtesy copy of the Notice of Hearing and Motion should be mailed  to the Judge’s office for review prior to the hearing. Counsel should bring proposed orders, sufficient number of conforming copies, and self-addressed stamped envelopes to the hearing - Refer to Administrative Order 2.306 Adobe PDF  of Florida Rules Judicial Administration.  

When canceling a UMC Hearing, please advise Division AJ as to cancellation of UMC Hearing via email at   DivisionAJ@pbcgov.org 

UMC Hearings are not confirmed, nor is receipt of Telephonic Notices -  as UMC hearings are designed to be a first ready-first serve basis and the sign-up sheet is the Docket.  There is no official daily "calendar" of UMC Hearings.
 
TELEPHONE APPEARANCE at Uniform Motion Calendar or Special-Set Hearings ONLY (not calendar call)  is permitted. 
Requesting counsel shall provide both the Court (via the US Mail)  and opposing counsel appearing in person a “Notice of Telephonic Appearance” containing the phone number at which he or she may receive a call from the Court, preferably toll-free. The Court will call the attorney at that number at the time of the hearing.  If additional parties wish to appear telephonically, the movant  is responsible to set up the conference call, thus providing ONE telephone number to the Judge.

SPECIAL SET HEARINGS (15 - 45 minutes):  Online e-scheduling -   Detailed instructions on utilizing the online calendaring are located inside Courtroom 10A or on the website at www.15thcircuit.com/onlinescheduling. 

The  Scheduling  of  Extended Hearing Requests for more than 45 minutes need to be set on the UMC  for the Court's approval of said Request.  Add-ons or Cross-Motions:  Please email DivisionAJ@pbcgov.org with your modification request and cc all other parties.  There must be agreement between the     parties to add the additional motion and/or to otherwise modify the hearing.  

Movant's citations of authority and Memoranda of Law (the original and one copy) should be mailed directly to the Judge's office at least seven (7) business days prior to the hearing indicating the date and time of the hearing.  The Clerk will not file Memoranda in the court file without the permission of the Judge.  The Motion and Memoranda are limited to ten (10) pages total.  Respondent's Reply Memoranda of Law is limited to five (5) pages and, along with the citations of authority, shall be mailed to the Judge's office at least three (3) business days prior to the hearing.  If materials are not received by these deadlines, the parties run the risk of not having the matter heard.  

Intention of canceling special set hearings should be emailed to DivisionAJ@pbcgov.org email us immediately and a proposed order of cancellation should be submitted via US Mail.
 
ALL ORIGINAL NOTICE TO SET CAUSE FOR TRIAL should be submitted directly to the Clerk.   A courtesy copy  with sufficient stamped, self-addressed envelopes should be sent directly to the Judge's office.   

ALL CONTINUANCES OF TRIAL require a hearing on the Uniform Motion Calendar prior to Calendar Call.
 
MISCELLANEOUS TRIAL INSRUCTIONS

Mediation shall take place prior to calendar call consistent with the trial order.
Pre-trial stipulations should be submitted prior to calendar call consistent with the trial order.
Proposed Jury Instructions shall be submitted to the Trial Clerk on the first day of trial.
All exhibits must be pre-marked pursuant to the Clerk of Court’s instructions. Please contact 561/355-4831 or 355-4833.

If the case settles, immediately contact the Judicial Assistant and/or  forward to the Court written notification of the settlement status at DivisionAJ@pbcgov.org
email us.  Upon receipt, the case will be removed from the Trial Docket.

If Mediation results in a case being resolved, a  courtesy copy of the Mediator Report should be sent directly to the Judge.
