
Divisional Instructions
***Please take note that there will be no more UMC's, all hearing's will have to be special set by my JA.***
All other motions for Division "RF" are specially set through the Judicial Assistant. The motion must be filed and docketed with the Clerk of Court prior to requesting a hearing date and time with a copy to opposing party. If there is an attorney on both sides several dates are given to the setting party so that a date and time can be coordinated as a professional courtesy;
Mediation & Final Hearings of Evictions are set and noticed by the Court for Thursday of each week at 8:30 a.m.;
Pretrial Hearings are held on Thursdays at 9:00 a.m. and 10:00 a.m. If either party requires a continuance, the request must be in writing with a copy to the opposing party ten (10) days prior to the pretrial date so that objections can be heard where practicable or as soon as possible, understanding that motion to continue may be heard at the time of hearing if not received in a timely manner;
The Court does not allow phone appearances at pretrials or non jury trials. All parties must appear in person unless the Court has granted prior approval to appear by phone after proper Motion and Order have been filed, with self addressed stamped envelopes;
To cancel a motion that is set for five minutes or less, a Notice of Cancellation must be filed with the Clerk. If the motion is ten (10) minutes or more, the Notice of Cancellation must note the reason for the cancellation with proper notice to opposing party;
All Non Jury Trials are set by the Court with attached information regarding mediation and uniform pretrial procedures. If the case settles prior to the trial date, a written confirmation of the settlement agreement must be filed with the Court by Plaintiff with a copy to opposing party;
All orders, unless previously ruled on at a hearing, must allow the Court the option to grant or deny the motion and must include necessary copies for all parties along with appropriately addressed envelopes including return postage;
All Jury Trials are set by the Court in an "Order Setting Jury Trial and Case Management Conference Directing Pretrial and Mediation Procedures;"
When submitting proposed orders to the Court for review, please attach the necessary copies and envelopes for all parties including return postage;
